PocketSuite Privacy Policy

This Privacy Policy (this “Privacy Policy”) governs your use of the PocketSuite mobile application (the “App”) that was developed by PocketSuite, Inc. (the “Company”). The Company is sometimes referred to herein as “we,” “us,” or “our” and the User (as defined below) is sometimes referred to as “you,” “your,” or “customer.”

The Company is committed to maintaining the confidentiality, integrity and security of any Personal Information (as defined in Section 2 below) about our Users. This Privacy Policy explains how we protect Personal Information provided through the App and how we use that information in connection with the services offered through the App (the “Services”). For a complete list of Services, please see our Terms of Service found at www.pocketsuite.io. We regularly re-evaluate our privacy policies and adapt them as necessary to deal with new challenges.

1. Who is affected by this Privacy Policy?

This Privacy Policy affects two groups of users: business owners and clients. Collectively these groups are referred to as the “Users”.

 

2. How does the Company collect personally identifiable information and what information is obtained?

The App obtains the information you provide when you download and register the App. Registration with us is mandatory in order to be able to use the basic features of the App. When you register the App, you generally provide: (a) your name, email address, mobile telephone number, password, date of birth, tax identification number, schedule, picture, and other registration information; (b) transaction-related information, such as when you book appointments with and send invoices to other Users or contacts; (c) information you provide us when you contact us for help; (d) credit card or banking information for making payments to and receiving payments from other Users or contacts; and (e) any other information you enter into the App (collectively, your “Personal Information”).

In addition, the App may collect certain information automatically, such as the type of mobile device you use, your mobile devices unique device ID, your mobile device operating system and information about the way you use the App (collectively, “Automatically Collected Information”). No data that is collect can personally identify you.

 

3. How does the Company use the information it collects?

The Company does not and will not sell or rent your Personal Information or Automatically Collected Information to anyone, for any reason, at any time. The Company uses and discloses your Personal Information and Automatically Collected Information only as follows:

• to analyze the App’s usage and improve the Services;

• to deliver to you appointment reminders, invoices, payments, receipts and communications relevant to your use of the App and the Services;

• to fulfill your requests for certain Services;

• for market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;

• to third-party contractors that provide services to the Company and are bound by the same privacy restrictions;

• to enforce the Company’s Terms of Service; and

• as otherwise set forth in this Privacy Policy or the Company’s Terms of Service.

 

4. Do third parties see and/or have access to information obtained by the App?

We may disclose your Personal Information and Automatically Collected Information:

• when required by any applicable law, rule regulation, subpoena or other legal process;

• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

• with our trusted service providers who work on our behalf, who do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Privacy Policy; and

• if the Company is involved in a merger, acquisition, reorganization or other change of control, to the purchaser or its affiliate if your Personal Information and Automatically Collected Information is part of the transaction.

Currently, the third parties we have engaged to work on our behalf include the following:

Mailgun, Inc., to send and receive email;

Twilio, Inc., to send and receive SMS; and

Stripe, Inc., to facilitate payments made to and received from the Users.

 

5. What are your opt-out rights?

You can stop all collection of information by the App easily by uninstalling the App. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

 

6. What is the Company’s data retention policy and how can you manage your information?

We will retain your Personal Information for as long as you use the App and for a reasonable time thereafter. We will retain Automatically Collected information for up to 12 months and thereafter may store it in aggregate. If you’d like us to delete the Personal Information that you have provided via the App, please contact us at privacy@pocketsuite.io and we will respond within a reasonable time.

 

7. What else do you need to know?

(a) Children. We do not use the App to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at privacy@pocketsuite.io immediately. We will delete such information from our files within a reasonable time.

(b) Security. We are concerned about safeguarding the confidentiality of your Personal Information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain and use a combination of firewall barriers, encryption techniques and authentication procedures. For example, we limit access to your Personal Information to authorized employees and contractors who need to know that information in order to operate, develop or improve our App. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

(c) Changes. This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy at www.pocketsuite.io. You are advised to consult this Privacy Policy regularly for any changes.

(d) Your Consent. By using the App and the Services, you are consenting to our processing of your Personal Information and Automatically Collected Information as set forth in this Privacy Policy now and as amended by us. “Processing” means using cookies on a handheld device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S. your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards. By using the App and providing information to us, you consent to such transfer to, and processing in, the U.S.
